NEUROZENIX SMS TERMS AND CONDITIONS (US-BASED TEXT MESSAGING PROGRAMS)

IMPORTANT! PLEASE READ THESE NEUROZENIX SMS TERMS AND CONDITIONS CAREFULLY BEFORE SIGNING UP FOR ANY NEUROZENIX INC. ("Neurozenix," "WE," OR "US") TEXT MESSAGING PROGRAM. BY SIGNING UP FOR ONE OR MORE OF NEUROZENIX'S TEXT MESSAGING PROGRAMS, YOU AGREE TO ABIDE BY AND BE BOUND TO THESE NEUROZENIX INC. SMS TERMS AND CONDITIONS. FURTHERMORE, THESE NEUROZENIX INC. SMS TERMS AND CONDITIONS CONTAIN AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH AFFECTS HOW DISPUTES WITH NEUROZENIX ARE RESOLVED.

By signing up for one or more text messaging programs, you expressly consent to receive marketing or non-marketing text messages, as applicable, from Neurozenix and others texting on its behalf, at the telephone number(s) that you provide. You may opt out of these communications at any time. Consent to receive text messages is not a condition of any purchase.

Program Description

Neurozenix text messages are intended to provide you with marketing and promotional information regarding Neurozenix products and services (e.g., special offers, product updates, events, and promotions). We may also send transaction-related information, including order confirmations, shipping notifications, customer service updates, and account-related communications.

Message Frequency

The number of Neurozenix text messages you receive will vary depending on which Neurozenix text messaging programs you enroll in and the frequency of messages associated with those programs.

Cost

Message and data rates may apply to each text message sent or received in connection with Neurozenix text messages, as provided in your mobile service plan. Please contact your wireless carrier for pricing details. Neurozenix does not charge a separate fee for sending text messages; however, you are responsible for any charges imposed by your mobile carrier.

How to Opt In

To receive text messages from a Neurozenix text messaging program, follow the instructions provided when you enroll. For example, you may be asked to reply "YES" or another confirmation keyword to complete your subscription.

How to Opt Out

To stop receiving text messages from a specific Neurozenix text messaging program, reply STOP to the short code or phone number from which the messages are sent. You may receive one final confirmation message acknowledging your opt-out request. After that confirmation, you will no longer receive messages from that specific program unless you opt in again.

Opting out of one messaging program does not automatically unsubscribe you from other Neurozenix messaging programs you may have joined.

Your Mobile Telephone Number

You represent that you are the authorized account holder for the mobile telephone number(s) you enroll.

You agree to notify Neurozenix promptly if your mobile telephone number changes. You may contact Neurozenix Customer Support to update your information.

You agree to indemnify Neurozenix for any claims, costs, damages, or expenses resulting from your failure to notify us of a change to your mobile telephone number, including claims arising under the Telephone Consumer Protection Act (TCPA).

Mobile Network Availability

It is your responsibility to ensure that your wireless carrier supports text messaging and that your mobile device is capable of receiving SMS messages.

Delivery of text messages depends on your wireless carrier and network availability. Neurozenix is not responsible for delayed, undelivered, or misdirected messages, or for issues arising from wireless carrier services.

Supported Carriers

Supported carriers may change at any time but generally include major U.S. wireless providers such as:

• AT&T

• Verizon

• T-Mobile

• Sprint (where applicable)

• Boost Mobile

• Metro by T-Mobile

• U.S. Cellular

• Google Voice

Wireless carriers are not liable for delayed or undelivered messages.

Support / Help

For assistance, reply HELP to any Neurozenix text message or contact Neurozenix Customer Support through the contact information provided on our website.

Eligibility

To receive Neurozenix text messages, you must:

• Be a resident of the United States.

• Be at least 18 years old (or the age of majority in your state).

Neurozenix reserves the right to verify your eligibility at any time.

Changes to These Terms

Neurozenix may revise these SMS Terms and Conditions at any time. Updated versions become effective immediately upon posting on our website.

Your continued participation in any Neurozenix text messaging program constitutes your acceptance of any revised Terms and Conditions.

Termination

Neurozenix reserves the right to suspend or terminate your participation in any text messaging program at any time if you violate these Terms or if your mobile service is terminated or unavailable.

We may also modify, suspend, or discontinue any SMS program at our sole discretion, with or without notice.

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy relating to your enrollment in or receipt of Neurozenix text messages shall be resolved through binding arbitration rather than in court.

Any and all disputes, claims, demands, or causes of action between you and Neurozenix, including its affiliates, employees, officers, agents, successors, or assigns, shall be resolved exclusively through confidential, binding arbitration, except where either party may bring an eligible claim in small claims court.

Each party also retains the right to seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
